Unenforceable Credit Agreements - Credit Card & Loan debts wiped clear

Unenforceable Credit Agreements (UCA) Explained

Back in 1974 the UK government established a set of guiding principles for how the credit industry should operate. These guiding principles were wrapped together as the Consumer Credit Act and ALL companies who offer credit, whether it be via loans or credit cards must abide by the strict guideleines.

However, a lot of companies who in their eagerness to get hold of your hard earned money, and their ultimate greed, decied to take certain shortcuts when getting people to sign up for credit. In effect they did not follow the Consumer Credit Act to the 'letter' and as a result the Credit Agreements which loan and credit card applicants signed up to, were effectively rendered unenforceable i.e. unenforceable credit agreements. As a result lots of applicants can now 'refuse' to repay back monies due under the initial credit agreement and in some case could even claim back interest charges.

For example, unfair terms in your credit agreement could be:

  • that it doesn't show the correct or any credit charges
  • the specific details about the rate of interest and how long it stays at that rate
  • it doesn't have your hand-written signature
  • it doesn't include a notice of cancellation (if it is a cancellable agreement)
  • that the repayment schedule was not clearly defined and outlined
